Summary: The master's dissertation had as its object the mapping of the main rights of women identified in the Consultations and Resolutions of the Council of Imperial State from 1842 to 1882. It sought to inquire about the conceptualizations of law presented in the legal field for women in a markedly patriarchal Brazilian society. The object of study was limited to the civil field, more related to the field of private relations such as family. It started from a true nineteenth century paradox in which the conditions for women to demand more rights were shown; from another angle, there was the strength and influence of patriarchy in the way their legal roles were defined. In this way, an attempt was made to organize, based on doctrine, an analysis of the debates on the limits of women's rights, also considering the historical context, feminism and power relations. Considering the legal protections as well as the legal capacities established. The primary sources of the work were the Consultations and Resolutions contained in the work Imperiaes Resolutions Taken on Consultations of the Justice Section of the Council of State, Part I and II by José Prospero Jehovah da Silva Caroatá, and the secondary sources were, therefore, legal works written by Brazilian jurists in the nineteenth century, whose interpretation was based on the methodology of content analysis to determine the main categories or concepts of law applied to women.
